Negligence claims soaring – call in the Mediator

The Law Society Gazette reported today that professional negligence claims against solicitors are soaring. It has a not unconnected story that the compensation fund levy is set for a steep increase. I am not in a position to join Edward Cooper, my former colleague at Russell Jones & Walker,in commenting on the whys and wherefores of the increase.

Another former colleague of mine told me that he came to mediation through his role as complaints manager at a different firm. He witnessed at first hand negligence claims being efficiently resolved to the satisfaction of the client and the indemnity insurers. He acknowledged the role of skilled Mediators in this type of dispute.

If you are unfortunate enough to be involved in a professional negligence claim, whichever side of the fence you are on, consider mediation as a method of resolving the dispute quickly and with often surprising results.
