Mediation works because of a number of important factors:-
- It’s voluntary – which means that parties can walk away if they are unable to negotiate the result they want. This means there is less pressure, they are not going to “lose” because there is no judge or arbitrator to impose a decision on them.
- It is confidential – which means that parties can explore the strengths and weakness of their case with the Mediator without this being exposed to the other side.
- It can preserve important relationships – there is no winner and loser at mediation, simply a negotiated settlement. This means that working or trading relationships which have been stalled by the dispute can be preserved for the benefit of both parties.
- There is a skilled Mediator assisting the parties reach a solution. The Mediator is impartial and interested only helping the parties find their solution.
