Do I need a Barrister at Mediation?

This is a less easy question to answer than do I need a solicitor at mediation? Mediation is about negotiation so if your barrister is a skilled negotiator he/she is likely to provide valuable help. The barrister will also be able to advise on the strengths and weaknesses of the case helping you make better informed decisions.

The disadvantage is that your costs will increase. You therefore need to be clear why the barrister is attending. Can the functions the barrister is due to perform be adequately performed by your solicitor? Obviously a lot will turn on the amount of money or the seriousness of the issue in dispute so I really can not provide any more assistance than to suggest you discuss it carefully with your solicitor asking the questions outlined above and finding out what experience your barrister has representing clients at mediation.
