There are two elements to confidentiality:
- Confidentiality between you and the mediator
- Confidentiality between you and the other side
During the mediation anything that is said to the mediator in the private room is confidential. The mediator will never pass this on to the other side without your express permission. This enable you to discuss the case frankly with the mediator which helps the mediator determine the best way to assist you.
Anything said or done during the mediation is confidential between the parties and can not be discussed with external parties unless both sides consent.
