Yes mediation does work.
By success I mean:-
- A large proportion of mediations – between 70% and 85% - result in a settlement on the day or very shortly afterwards.
- Mediation settlements tend to be honoured by the parties because they designed the solution.
- Mediations resulting in settlement can save the parties considerable time and legal costs.
- Mediated settlements can “expand the pie” and leave both parties better off than either could have achieved with a court judgment creating a “win-win” result.
- Mediated settlements can preserve important working or commercial relationships.
