When courts order joint statements or reports from expert witnesses in litigation it can cause logistical problems for solicitors. The court will have given a deadline for the report to be prepared, something which expert witnesses are not always cognisant of. Part 35 of the CPR was amended in 2009 tightening up the requirements of the content and form of expert witness reports. Solicitors have two problems; getting a report on time that meets the requirements of Part 35.
Facilitating Joint Reports
I offer a service of co-ordinating the perparation, writing and delivery of expert witness joint reports. I arrange convenient times for the experts to meet/discuss the report and help them focus on the issues and ensure that the report is fully compliant with Part 35 as well as being useful and relevant to the litigation process. I aim to have the report delivered on time. If I see problems developing which will cause delay I can report the steps taken to the parties enabling them to make an informed application for further time if necessary.
My dealings with the experts are entirely confidential and without prejudice save as to the reporting of the causes of any delays.
